DX Consulting PLT and our affiliates (collectively, “DX”, “DX Consulting”, “we,” “us,” “our,” or “DX Consulting PLT”) cares about your privacy. We are committed to maintain your trust by protecting your Personal Information. This Privacy Statement (“Statement”) describes how DX Consulting PLT collects, uses, and discloses your Personal Information in connection with the use of our websites (“Website Services”), applications (“apps”), or other service that refers to or links to the Policy, as well as any offline products, programs, courses, and services (collectively our “Services”). Please review this statement to learn more about how we collect, use, share and protect the personal information in accordance with the Personal Data Protection Act 2010 (“PDPA”) and the laws of Malaysia that we have obtained.

For the purposes of this Privacy Statement, please note that:

  1. "Personal information" refers to any information which relates directly or indirectly to you and/or your transactions with us. This information includes your name, address, occupation, contact details, the details of your account(s), the type of products and/or services subscribed to and such other necessary information regarding yourself and your transaction(s) with us. For the avoidance of doubt, please note that this Privacy Policy is applicable only if you are an individual.
  2. "DX" refers to the Service Provider DX Consulting or DX Consulting PLT (Company No: LLP0022798-LGN), a company incorporated in Malaysia having registered and business address at registered address at Level 23-1, Premier Suite, 1 Mont Kiara, No 1, Jalan Kiara, Mont Kiara, Kuala Lumpur, 50480 Malaysia.

 

Collection of Personal Information

Your personal data could be obtain from yourself and from a variety of sources including but not limited to a. through your relationship with us, for example information provided by you in application forms, when signing the Service Agreement, when using our products or services, when enroll into our program or services, when taking part in DX’s customer surveys, competitions and promotions, and during financial reviews; through your verbal and written communications with us and/or our authorized agents; through any videos collected by us and/or our authorized agents; from third parties connected with you, such as employers, joint account holders, guarantors, subject to your prior consent; from an analysis of the way you use and manage your account(s)/facility(ies) with us, from the transactions you make and from the payments which are made to/from your account(s)/facility(ies); from any interactions between DX coworking space members through community platforms including but not limited to notice board, social media, DX’s Facebook, DX’s Instagram, DX’s online forums and chat applications, DX’s shared internet access; and/or from such other sources in respect of which you have given your consent to disclose information relating to you and/or where not otherwise restricted. Other information we collect will depend on the privacy settings you have set with your social media provider, so please review the privacy statement or policy of the applicable service. In some cases, you will have previously provided your personal information to DX (if, for example, you are a former employee).

Please read this Privacy Statement to understand how we use the personal information we may collect from you. By providing your Personal Information to us, you are consenting to this Privacy Statement. If you are a corporation supplying personal information of your directors, shareholders and/or officers to us, please do ensure that you have duly obtained their consent and bring this Privacy Statement to the attention of your directors, shareholders and/or officers whose personal information you are supplying/have been supplied to us.

DX only collects "sensitive" personal data where such information is required or permitted to be collected by law or professional standards. Sensitive personal data includes personal information regarding a person’s political beliefs, trade union membership, religious or similar beliefs, physical or mental health, sexual life or criminal record. Please use your discretion when providing sensitive information to DX, and under any circumstances, do not provide sensitive information to DX, unless you thereby consent to DX's use of that information for its legitimate business purposes and consent to the transfer and storage of such information to and in DX databases. How we use your Personal Information

When you register or submit personal information to DX, we will use this information in the manner outlined in this Privacy Statement. Your personal information is not used for other purposes, unless we obtain your permission, or unless otherwise required or permitted by law or professional standards. For example, if you register to a DX web site and provide information about your preferences, we will use this information to personalize your user experience. Where you register or login using a third-party single user sign-in, we may also recognize you as the same user across any different devices you use and personalize your user experience across other DX sites you visit. If you send us a resume or curriculum vitae to apply online for a position with DX, we will use the information that you provide to match you with available DX job opportunities. DX generally collects only the personal information necessary to fulfil your request. Where additional, optional information is sought, you will be notified of this at the point of collection.

Other than as stated above, we may use your personal information to assess your application(s) for our products and services; to verify your financial standing through credit reference checks; to manage and maintain your account(s) and facility(ies) with us; to manage our business and your relationship with us; to better understand your current and future financial needs and your financial situation; to provide you with information on our and 3rd party products, services and offers which may be of interest to you; to improve our products and services and to develop new products and services; to notify you about benefits and changes to the features of products and services; to administer offers, competitions and promotions; to respond to your enquiries and complaints; to improve the quality, efficiency and utilization of DX’s services; to update, consolidate and improve the accuracy of our records; to produce data, reports and statistics which have been anonymized or aggregated in a manner that does not identify you as an individual; to conduct research for analytical purposes including but not limited to data mining and analysis of your transactions with us; to meet the disclosure requirements of any law binding on DX; for audit, compliance and risk management purposes; to assess financial and insurance risks; to transfer or assign our rights, interests and obligations under any of your agreement(s) with us; to protect or enforce our rights to recover any debt owing to us; for crime detection, prevention and prosecution; and/or for any other purpose that is required or permitted by any law, regulations and/or guidelines. From time to time, we may use your Personal Data to send important notices, emails, letters or sms, like communications about purchases and changes to terms, conditions, and policies. As such information is crucial to your custom with us, you are advised not to opt out of receiving such communications. We may also use your Personal Data for internal purposes such as auditing, data analysis, and research to improve our products, services and customer communications.

Cookie Usage. We use cookies across our website to enhance your user experience. The cookies are utilized to analyze how visitors use our websites and to monitor website performance. This allows us to provide a better user experience by customizing our offerings and quickly identifying and fixing any issues that arise. For example, we might use performance cookies to keep track of which pages are most popular. IP Address. An IP address is a number assigned to your computer whenever you access the internet. It allows computers and servers to recognize and communicate with one another. IP addresses from which visitors appear to originate will be recorded for IT security and system diagnostic purposes. This information will also typically be used in aggregate form to conduct web site trend and performance analysis.

Location-based tools. DX will collect and use the geographical location of your computer or mobile device. This location data is collected for the purpose of providing you with information regarding services which we believe may be of interest to you based on your geographic location, and to improve our location-based products and services.

 

Disclosure of your Personal Information

As a part of providing you with our products and services and the management and/or operation of the same, we may disclose your personal information (to the extent necessary) to the following third parties - companies and/or organizations that act as our strategic partners, agents, professional advisers and/or any other parties that we may have business or dealings with; companies and/or organizations that assist us in processing and/or otherwise fulfilling transactions that you have requested; companies and/or organizations that assist us in providing value added services that you have requested; your advisers (including but not limited to accountants, valuers, adjustors, auditors, lawyers, financial advisers or other professional advisers) where authorized by you; any person notified by you as authorized to give instructions or to use the account(s)/facility(ies) or products or services on your behalf; and/or any third party as a result of any restructuring of facilities granted to you or the sale of debts, or the acquisition or sale of any company by DX, provided that any recipient uses your information for the same purposes as it was originally supplied to us and/or used by us; any guarantors of security providers for the facility(ies) granted by us to you; any person intending to settle any moneys outstanding under the facility(ies) granted by us to you; any rating agency, insurer or insurance broker or direct or indirect provider of credit protection; any financial institutions, merchants, VISA International Services Association, MasterCard International Incorporated and other card associations in relation to any credit card and/or debit card issued to you; and/or any person connected to the enforcement or preservation of any of our rights under your agreement(s) with us, to safeguard your personal data, all electronic storage and transmission of personal data are secured with appropriate security technologies.

All parties mentioned in the clause above may in turn disclose your personal information to companies within their group of companies, their affiliates and directors, shareholders, employees of such companies and affiliates, their professional advisers, service providers, strategic partners, regulators and other parties on a “need to know basis” who or which may have business or dealings with them.

Additionally, the individual entities within DX may contact you about services and offers, which we believe may be of interest to you or benefit you financially. You may tell us at any time if you do not wish to receive marketing communications from us, from individual entities at DX by writing to us. Your latest written instructions to us will prevail. As for our third-party merchants or strategic partners, we will only contact you for marketing purposes of their services/products if you opt-in to receive the same from us by completing the consent form available at the servicing branch.

We treat your personal information as private and confidential and will not disclose your information to anyone except in any of the following situations where you have given permission; where we are required or permitted to do so by law; where required or authorized by any order of court, tribunal or authority, whether governmental or quasi-governmental with jurisdiction over DX; where we may transfer rights and obligations under this agreement; and/or where we are required to meet our obligations to any relevant regulatory authority.

Your Rights

We can assist you to access and correct your personal information provided to us.

Access and correction: you may have access to your personal information by making a request via the access request form available at the Center, subject to payment of the relevant processing fee (if applicable). We will use reasonable efforts to provide you with a copy of the requested personal information within 21 days of receiving your duly completed Access Request Form and the processing fee. Please note that DX may have to withhold access to your personal information in certain situations, for example when we are unable to confirm your identity or where information requested for is of a confidential commercial nature or in the event we receive repeated requests for the same information. Nevertheless, we will notify you of the reasons for not being able to accede to your request. Where your data access request is successful and you are of the opinion that such personal information held by us is inaccurate, incomplete, misleading or where relevant, not up to date, you may make a request to correct such personal information. You can also assist us to keep your personal information (such as your current mailing address) up to date, as it will enable us to serve you better. In the event you wish to correct / update your personal information previously provided to us, please write in or notify us at the address provided below. We will use reasonable efforts to comply with your request to correct your personal information within 21 days of receiving your written request. Please note that DX may use its discretion in allowing the correction / update requested or may require further documentary evidence of the new information to avoid fraud and inaccuracy.

Object to processing: it is obligatory to provide your personal information to us to enable us to process your application for our products or services. Should you decline to provide such obligatory personal information, we may not be able to process your application/request or provide you with our products or services.

Other Rights: in addition, you may have rights to have your information deleted if we are keeping it too long, have its processing restricted in certain circumstances and/or to obtain copies of information we hold about you in electronic form.

This Privacy statement may be amended by us by giving the requisite notice in order to comply with regulatory requirements.
